Do you have your SAT data up to date? The Service could have you in its sights as early as July.

As with the CFDI 3.3, the extension given by the Tax Administration Service (SAT) to individuals who changed their tax regime in 2022 is about to end.

This extension was to update their means of contact in the Tax Mailbox and to process their electronic signature(e.firma).

The deadline expires on June 30, which means that taxpayers must have the information as required by Article 113-G section II of the Income Tax Law by July 1, 2023.

Specifically, the SAT is targeting those belonging to the Simplified Trust Regime (RESICO).

It should be noted that in RESICO Individuals with an income of less than 3 million 500,000 pesos and legal entities whose income does not exceed 35 million pesos can pay taxes.

But be careful, these taxpayers will not be able to continue paying taxes under this regime if they do not comply with the tax legislation.

A great advice to all taxpayers, as reminded by the Procuraduría de la Defensa del Contribuyente (Prodecon), is to validate the tax regime in which they are by means of the Tax Status Certificate (Constancia de Situación Fiscal).

In this way, they will avoid sanctions by the authority for omissions.

In case of not having the e.firma, the SAT detects this inconsistency and initiates a process of regime change, regardless of whether the activity is business, fees or leasing; hence the importance of having updated tax data.

Now, if your tax regime does not correspond to the activities you perform, do not worry, you can still initiate a clarification process from the SAT portal, as specified in rule 2.5.8 of the Miscellaneous Tax Resolution.

With this procedure, the service will be able to update your situation and determine the obligations that correspond to you.

But not everything is negative, there are advantages to being in RESICO such as being able to obtain more than one type of income regardless of the type of activity performed.

For example, if you have to issue an invoice for providing professional services, but you are also a salaried employee in a company, you can perform this action.

As long as the income does not exceed the 3 million 500,000 pesos mentioned above.

So now you know, make sure that all your data is correct in the SAT and avoid surprises in the future.
