Actions to generate "decent jobs" continue. First with an increase in vacation days, and now a reduction in the workday and a Saturday bonus are being sought.

Of course, in addition to the increase in vacation time by law, we have the increase in the minimum wage and the increase in the workers' and employers' contributions (COPs).

For months, the legislative interest has been on the table to reduce the workday, which is currently 8 hours and six days a week, to 4.5 days a week and a Saturday bonus, just like the one currently enjoyed by workers who work on Sundays.

In addition to this change, new formulas for calculating this are to be established in the Federal Labor Law (LFT).

Currently, what does the law say about working hours?

Today, the Federal Labor Law establishes that the limit of time a person can work is 48 hours per week, which is divided into 8 hours during 6 days.

But results from the National Occupation and Employment Survey (ENOE) show that there are 10.4 million people who work more than the legal limit.

In 2021, Mexico was the country with the most hours worked per year among the economies that make up the Organization for Economic Co-operation and Development (OECD).

The global average of the organization's members is 1,716 hours per year, while in Mexico the average is 2,128 hours.

Which articles of the LFT are being amended?

First, it is proposed to amend Article 59 of the Federal Labor Law, which refers to the length of the workday. Such change would result in weekly breaks starting on Friday afternoon.

It is also proposed to amend Article 69 to establish that for every four and a half days of work, employees will have at least two and a half days off with full pay.

Finally, Article 71 is to be amended to establish that the regulations of this law shall provide that the weekly days of rest shall be Friday afternoon, Saturday and Sunday.

This article currently provides for a Sunday premium of 25% of the salary for those who work on that day, and it will be extended to those who work on Saturdays.

What do you think of these reforms to the Federal Labor Law? Do you think it will be easy to adapt them to your business scheme?
