In Mexico, unfortunately, there are companies that use payroll benefits, such as pension plans, to take advantage of the law and their workers.
That is why the Tax Administration Service (SAT) informed that such simulation of pension plans, in order to avoid paying taxes, is a crime.
Not only that, but it is punishable by up to 13 years in prison.
In the same communiqué, it mentions that this also impacts workers because it affects their health, housing and pension benefits.
In addition, he pointed out that there are some private firms that are offering companies these types of fraudulent pension schemes in order to avoid paying taxes.
Of course, without naming names, but implying that he knows who does it.
He stated textually:
"The Tax Administration Service has detected that there are firms that offer
employers schemes that simulate to be pension plans, with the intention of evading the payment
of contributions for the payroll of their workers."
The SAT points out that, generally, companies give money to their active workers and pretend that they are payments for retirement, pensions or other forms of retirement.
But in reality they are payroll payments that are intended not to be considered as part of the employee's salary and are income exempt from income tax (ISR).
That is why "the service" calls on employers not to contract such plans.
And what about the workers?
He invited them to know their rights and to report any anomaly by e-mail.
