Is it necessary to issue CFDI for payroll advances?

It is common, and to a certain extent normal, for an employee to request a payroll advance due to an emergency or unforeseen event.

In many of these cases, we usually put it in writing to give consent and materiality to the act by both parties.

This is in case of any questioning by the tax authorities.

But here's a news flash, this type of agreement is not enough for tax purposes.

This is because the employer, when granting a payroll advance, must issue the corresponding payroll CFDI indicating the amount paid.

Why should I issue CFDI for payroll advances?

The issuance of the CFDI must be done as mentioned in the "Guide for filling out the payroll receipt and its complement", which applies to CFDI version 4.0 and the payroll complement version 1.2.

This guide was published on the Tax Administration Service (SAT) web portal on December 31, 2021 and indicates all the specifications that the taxpayer must keep in mind for the correct issuance of the payroll CFDI.

These payroll advances must:

  • Be duly stamped
  • To be of an extraordinary type
  • Specify the amount of the salary advance paid
  • Have the type of payment key 038 "Other income from salaries".

But this is not all, because later, when the employer deducts these advances from the employee's paycheck, he/she must register them using the type code:

  • Deduction "012" (Advance payment of salaries)

In such CFDI.

So, as you can see, it is necessary that the employer verifies that it complied with all the aspects regarding the issuance of the payroll CFDI at the time of delivering the payroll advances.

It is also important to mention that, if you are still in time, you can cancel and substitute such vouchers, before being required by the authority.
