December has arrived and that means that, for many, the Christmas bonus payment is getting closer and closer.
Let us remember that the deadline to make the payment to our employees is December 19. But what happens if they do not receive this benefit, if it is not paid in full or at a later date? Here we will tell you.
If this is the case, employees may file a complaint with the labor authority.
Employers" could be fined up to $481,100 pesos for each affected employee.
All this is in accordance with number 28 of the General Regulations for Labor Inspection and Application of Sanctions, which states that:
Extraordinary inspections are those that: are carried out at any time, including non-business days and hours, without prior notice; and proceed, among other cases, when the authority becomes aware of possible violations of labor legislation through a complaint or becomes aware of possible irregularities attributable to the employer.
That is why we must pay close attention to the special rules that apply to this benefit, the payment of Christmas bonus, in order to calculate it in accordance with the law and deliver it in due time and form.
Otherwise, as mentioned above, fines ranging from 50 to 5,000 times the UMA, i.e., from Ps. 4,811 to Ps. 481,100, may be imposed on each affected employee.
