Senate already approved 12 vacation days, what's next?

Just a couple of weeks ago we shared the news about the "freezing" in the discussions to approve the so-called "Dignified Holidays".

But the situation changed again and, although today the subject was not scheduled to be taken up again, a space was opened in the agenda of the session where finally, with 89 votes in favor, the increase in vacation days from 6 to 12 days in the first year worked, adding two days each year, was approved.

These 12 days will be mandatory and with pay for all employees.

When does the increase in vacation time take effect?

The next step is that it passes to the Chamber of Deputies to be discussed and approved, then to the Federal Executive for its approval.

Once these approvals are obtained, the reform will be published in the Official Gazette of the Federation (DOF), but it is expected to become effective as of January 1, 2023, or the day after its publication in the DOF, and will be applicable to individual or collective bargaining agreements in force as of the effective date of the reform.

Articles 76 and 78 of the Federal Labor Law will be modified by the reform.

"Working persons with more than one year of service shall enjoy an annual period of paid vacation, which in no case may be less than twelve working days."
