Sunday premium: According to the law, how much must be paid for work on Sundays?

All companies, according to the Federal Labor Law (LFT), are required to give at least one day of rest to their employees; and make sure it is on Sundays.

At the same time, all employees are obliged to work a full working day, but those who work on Sundays at the employer's request must receive an additional payment, known as Sunday premium.

This is stated in Article 71 of the LFT.

How is the Sunday premium calculated?

In accordance with the aforementioned Federal Labor Law, the Sunday premium must be 25% over and above the employee's daily salary.

This means that the employee receives, as an extra, 25 percent of the salary he/she receives on an ordinary day of his/her normal working day.

Do not forget that these payments must be clearly indicated in the employee's payroll receipts , otherwise you could be sanctioned by the authorities.

It is important not to confuse the Sunday premium with the mandatory rest days, which are paid triple for working them.

In these cases, according to Article 75 of the LFT, the employee's daily salary must be paid, plus double.

Mandatory days in Mexico are, for example:

  • January 1 (New Year's Day)
  • 1st Monday of February (Commemoration of the Constitution)
  • May 1 (Labor Day)
  • September 16 (Commemoration of Independence Day)
