The Outsourcing Reform has brought a series of benefits and some obligations for workers, one of which is the REPSE.

The REPSE or Registry of Specialized Service Providers (or Specialized Works) is a platform created by the Ministry of Labor and Social Welfare (STPS) as a result of the aforementioned reform.

Its objective, as part of the new law, is that all companies that provide services that are carried out inside their clients' facilities must register with the STPS in the REPSE portal.

It is important to mention that if the companies provide this type of services, where their workers work at their clients' facilities (it could be considered "inhouse"), and the employers do not obtain their registration before the REPSE, they will not be able to provide the service.

Yes, registration is an obligation and complies with Article 15 of the Federal Labor Law.

What do "specialized services" refer to?

As we know, outsourcing was banned due to the bad practices of some companies with their workers. But, although outsourcing was abolished, the practice of so-called "specialized services" was allowed.

These services are characterized by the fact that they do not contribute to the client's economic or social activity.

For example, in a factory, security personnel or watchmen are not part of the production or creation of goods, so their services fall under specialized services.

Which specialized service companies must register with REPSE?

Some examples of companies whose lines of business, activities or services fall under "specialized services" are:

  • Logistics companies
  • Security companies
  • Cleaning services
  • Contractors and construction
  • Industrial safety
  • Industrial maintenance
  • Industrial dining rooms
  • Quality control
  • Occupational health

How to register your company in the REPSE?

The registration must be carried out in the REPSE portal.

Have at hand the e-signature or electronic signature of the individual or legal entity to be registered, and check the risk levels and categories of your company according to the "catalog of activities for the classification of companies in the occupational risk insurance" of the Mexican Social Security Institute (IMSS).

This will save you a lot of time.

Now follow these steps:

  1. Once you enter the e-signature, the system will validate that the individual or legal entity does not have any debts with the IMSS, SAT and INFONAVIT. Be careful: If there are any debts before any of these institutions, they must be paid before trying to register again.
  2. General data of the person to be registered will be requested.
  3. You will have to indicate the level and category of risk to which your company belongs according to the IMSS activity catalog mentioned above.
  4. Indicate the activities you wish to register, this is according to the tax status certificate or the corporate purpose of your company.
  5. Next, you will need to upload some files: Proof of tax status, articles of incorporation, current official identification of the legal representative, proof of registration in the RFC, employer's records before the IMSS, power of attorney, proof of address and proof of payroll.
  6. Once you have completed the questionnaires and uploaded the information, you will be given a folio with which you will be able to track your registration in the REPSE.
  7. Registration takes approximately 20 business days. Once approved, a notice is issued with a folio number for each activity that has been registered.

Finally, it is very important to emphasize that contracting or selling specialized services without a REPSE registration puts both suppliers and clients at risk, since both would be breaking the law.
